Public Procurement and Public–Private Partnership
GOAL OF THE STUDIES
The goal of the studies is to familiarise students with the complex, changing legal regulations on public procurement and public-private partnership as methods of implementing public service performance in Poland, taking into account the legal solutions of the European Union and the regulations adopted on the global public procurement market.
DESCRIPTION
The studies provide the opportunity to learn about the latest organisational and legal solutions regarding the functioning of public procurement and public-private partnership as methods of implementing public service performance. In 2014, new European Union directives were adopted, which significantly influenced the new shape of the legal regulation of spending public funds on the implementation of public procurement. Undoubtedly, these directives cause many interpretative problems concerning the issue of legal institutions related to public procurement, and thus require appropriate interpretation, helpful in particular for participants in the procedures for selecting contractors. On 11 September, 2019, a new Act was passed – Public Procurement Law, which entered into force on 1 January, 2021, therefore the studies are addressed not only to representatives and employees of the public sector (mainly from the Śląskie Voivodeship and Małopolskie Voivodeship), but also also to entrepreneurs (i.e. contractors and private partners) who face numerous practical problems – of informative and interpretative nature – in the area of the discussed institutions.
GRADUATE PROFILE
After completing the studies, the graduates possess:
- structured, in-depth and extended knowledge of law in the field of public procurement law and public-private partnership, taking into account relations oriented to the practical application of the acquired knowledge within the disciplines of administration law, civil law, financial law and criminal law
- knowledge of the structures and entities operating on the public procurement market and the accuracy of relations between participants operating on the economic market
- in-depth knowledge of the methodology of performing tasks, standards, procedures and good practices used in public procurement and public-private partnership
- the ability to correctly interpret legal, economic and financial phenomena in the field of public procurement and correctly identify mutual relations between these phenomena
- the ability to use theoretical knowledge of subject law and disciplines in the field of administrative and financial law in order to provide a detailed description and practical analysis of phenomena and solve problems within public procurement and public-private partnership
- the ability to diagnose and design practical activities in the field of public procurement and public-private partnership
- the ability to form their own opinion and analyse the provisions on public procurement and public-private partnership
- the ability to propose their own solutions to a specific problem and make decisions in this area as well as implement the proposed solutions
- skills in preparing contracts, specifications, offers, plans, documents, reports and studies used in public procurement and public-private partnership
- the ability to choose the most advantageous options of a public-private partnership for a specific project and to identify issues related to public finances and financial aspects related to the partnership
- the ability to use and influence public procurement and public-private partnership in the social, environmental and IT area.
CURRICULUM
The curriculum covers the issues of the legal basis for the functioning of public procurement and public-private partnership in the light of Polish and European law, public procurement procedures, preparation of the procedure and documentation (announcements, specification of essential public procurement conditions, etc.) by the contracting authority, preparation of offers by contractors, the process of organising and operating of authorities related to public procurement, public procurement contracts and contracts concluded under public-private partnership, appeal procedures, procurement control system and public-private partnership.

Organisation of classes:
The classes take place once a week, on Fridays from 3.15 p.m. to 8 p.m.
Graduation criteria:
In order to complete postgraduate studies, a student must write a diploma thesis.
Graduation document:
Postgraduate diploma issued by the University of Silesia in Katowice.

Candidates
The studies are addressed to both, practitioners dealing with procurement issues, as well as to people who wish to learn about the subject of public procurement and public-private partnership. The comprehensive scope of subjects discussed during the studies makes them an attractive offer both for the broadly understood government and local government administration, as well as for entrepreneurs who wish to participate in procedures related to applying for a public procurement or performance of a contract under public-private partnership.

Admission criteria:
Candidates are admitted to studies according to the registration order and the result of the admission procedure (if it was conducted).

FEES
After being admitted to postgraduate studies, you may start your studies, subject to paying the fee for postgraduate studies. Payments should be made to the student’s individual account, within the deadlines specified in the agreement.
